General Terms and Conditions of Use for the Trade Fair App | Use with Koelnmesse Account
The provider of the Trade Fair App (hereinafter: “app“) is Koelnmesse GmbH (hereinafter: “Koelnmesse”).
In order to use our app, you must accept the following terms and conditions of use. You should therefore read them through carefully.
1. General Terms and Conditions of Use
This app enables you to access extensive information about our event. Further details can be found in Item 2.
The app and its functions may not be misused in any way. As a result, you may only use the app in a legally appropriate manner and in accordance with our terms and conditions of use. We reserve the right to exclude you from the use of this app if you violate applicable German law or our terms and conditions of use.
You do not acquire any intellectual or industrial property rights by downloading our app.
2. Functions of the app
The app offers you the following functions:
a. Basic functions:
- Exhibitors/products: Information about all the exhibitors and products of the respective Koelnmesse event
- Favourites: You can add interesting companies, brands, products and event programme items to your favourites
- Programme: Overview of the event programme
- Plan of the halls and the exhibition centre: Find your way around with the help of our plan of the halls and the exhibition centre
- Information: Find all of the key information concerning topics such as arrival, accommodation and opening times
The basic functions are available to any user after the app has been installed even if an event ticket has not been purchased.
We reserve the right to change, discontinue, remove or interrupt the operation of these basic functions at any time and for any reason without prior notice. This can be done because it is necessary or in order to conduct scheduled or unscheduled maintenance, eliminate faults or make other changes.
b. Additional functions:
- Networking function and settings: The networking function, offered depending on the event, allows you to directly contact other participants and form networks. The app distinguishes between “public participants” in an event and “private participants.” This distinction is necessary in order to determine if and at what time a contact is available for networking with you.
- “Public participants” are (i.) the persons mentioned by the respective exhibitors and (ii.) individuals who provide a certain service as defined by an agreement with Koelnmesse, e.g. speakers or presenters. These persons are generally available for the networking function in order to fulfil the contract.
The public participants also include (iii) those trade visitors who have not deactivated the networking functions. - “Private participants” are all users who have deactivated the networking function. These individuals are deleted from the People directory if they have deactivated this function.
- “Public participants” are (i.) the persons mentioned by the respective exhibitors and (ii.) individuals who provide a certain service as defined by an agreement with Koelnmesse, e.g. speakers or presenters. These persons are generally available for the networking function in order to fulfil the contract.
The networking function is activated as a default setting. You can deactivate them or reactivate them at Home/My Profile.
We will import the contact details that are known to us from upstream systems (e.g. Ticket Shop, CRM system) into the app for your use. You can then complete this information in the app at any time.
- Ticket Wallet: The Ticket Wallet function contains your trade fair ticket and the ticket for the public transportation system.
You need a Koelnmesse Account in order to use these additional functions.
c. Special data protection provisions for lead tracking
If you participate in an event in Cologne, you will be offered a lead tracking service depending on that particular event. This enables exhibitors and visitors to electronically exchange personal data.
Trade fair visitors can voluntarily agree to have their data forwarded. Koelnmesse GmbH forwards the personal data to third parties only if the visitors first agree to have their data used in this way.
Neither the exhibitor, nor Koelnmesse GmbH nor any other third party can require visitors to take part in the trade fair app’s lead tracking feature and so to pass on their personal data. In addition, the exhibitor is obliged in individual cases to delete the personal data that it has received as a result of lead tracking if it is requested to do so by Koelnmesse GmbH or the visitor in question. Koelnmesse GmbH is not liable for the accuracy and completeness of the visitor registration data.
The exhibitor may only forward the personal data received as a result of lead tracking to third parties if and to the extent that the exhibitor has received express consent from the respective visitor. The exhibitor also undertakes to use the personal data received as a result of lead tracking solely in accordance with the legal regulations, especially those relating to data protection, and solely for the exhibitor’s own purposes. In this respect, the exhibitor shall exempt Koelnmesse GmbH from all claims by third parties.
3. User data
A tracking tool is used in order to continuously improve the app. For this purpose, we use Google Analytics SDK. This tracking tool is activated in the default setting. You can deactivate this function in the app’s system settings.
4. Rules of conduct
When using this app, you undertake to abide by the basic principles of “netiquette.” Anyone who violates these principles can be excluded from the use of the app.
5. Liability
Koelnmesse does not guarantee the app’s availability, reliability, functionality, or suitability for your purposes. Any liability is excluded to the extent that such liability is not mandatory according to the Product Liability Act or due to intent, gross negligence, injury to life, limb or health, due to the assumption of a quality guarantee or fraudulent concealment of a defect or due to the breach of essential contractual obligations. Essential contractual obligations are those obligations the fulfilment of which makes the orderly implementation of a contract possible in the first place, and the observance of which the parties to the contract regularly rely on and can expect to rely on. The damages due to breach of essential contractual obligations are limited to foreseeable damage typical of the contract insofar as there is no intent or gross negligence.
6. Termination
You can terminate the contract concerning the use of the app (including the networking functions) at any time and without giving any reasons by changing the corresponding setting at Home/My Profile in order to deactivate the app or by sending an e-mail to datenschutz-km@koelnmesse.de. Koelnmesse also has the right to terminate the contract concerning the use of the app if it has good cause to do so.
7. Data protection provisions
All personal information, data and materials that you send to us during registration or later on are subject to our privacy policy.
8. Applicable law
These terms and conditions of use are governed by German law. If you are a merchant as defined by Germany’s Commercial Code, it is agreed that Cologne is the exclusive place of jurisdiction for all disputes as a result of or in connection with these terms and conditions of use, including all issues regarding the existence, validity or termination of these terms and conditions of use.
9. Severability clause
Every provision of these terms and conditions of use is to be interpreted separately and independently. In the event that a provision of these terms and conditions of use is in whole or in part invalid or incapable of enforcement then the effectiveness of the remaining provisions of these terms and conditions of use shall not be affected as a result. In this event the affected provision is to be limited or struck out only to the extent that is absolutely necessary and replaced by a valid provision that corresponds as closely as possible to the purpose of these terms and conditions of use.
